В Ленинском суде Краснодара сегодня, 29 марта, состоялось третье предварительное слушание по делу руководителя правозащитной организации "ЭТнИКА" Анастасии Денисовой.

"Суд пока так и не удовлетворил наше ходатайство о том, чтобы дело было возвращено на доработку в прокуратуру, не смотря на то, что в нем очень много ошибок, - говорит Анастасия Денисова. Сегодня на слушании был опрошен руководитель Межрегиональной общественной организации "Союз криминалистов" Олег Плетень. Ему следователь Игнатенко поручил проведение экспертизы, по итогам которой и был сделан вывод о том, что на изъятых системных блоках были установлены и использовались контрафактные программы Microsoft и Corel. Плетень заявил, что он как руководитель перепоручил проведение исследования эксперту Юрию Воеводину. Если это так, то не понятно почему именно следователь предупреждал об ответственности Воеводина". Согласно УПК, если экспертиза назначена в учреждение, то разъясняет права и информирует об ответственности — руководитель учреждения, если назначена лично эксперту — то следователь.

Также защита Денисовой заметила в деле путаницу с датой совершения преступления, местом изъятия системных блоков, в которых якобы были найдены установленные "нелицензионные и вредоносные программы для ЭВМ".

"На скриншоте одной из программ, предоставленном экспертами, была видна дата открытия файла - 5 февраля, а завершение экспертизы датировано 27 января, - сообщила Денисова. Кроме того, опрошенный на слушании следователь Игнатенко (который сам явился в суд без вызова) не смог точно сказать, на какой улице находилось помещение, где производилось изъятие системных блоков, а в бумагах фигурирует то Ленина, то Фрунзе. Все это было названо "техническими ошибками".

Эксперт Воеводин в заседании суда опять не принял участие. Дополнительное слушание по делу суд назначил на 31 марта 11 утра. Судья заметил, что следующее слушание будет последним предварительным, потому что нужно придерживаться сроков и назначать уже открытое заседание по существу.

Анастасия Денисова все ещё надеется, что судья не допустит открытого заседания по столь абсурдному обвинительному заключению. На данный момент, несмотря на открытые обращения в Майкрософт от имени ПЦ «Мемориал», Трансперенси Интернешнл — Россия, а также ряда фирм-распространителей ПО — корпорация хранит молчание. По данным различных организаций на открытое судебное заседание по делу Анастасии Денисовой готовы приехать наблюдатели от Уполномоченного по правам человека в Российской Федерации, от Президентского Совета по правам человека, из нескольких международных организаций России и Европы.
